The Southern California Toyota Dealers Association “99 Ranch Market Toyota 2019 Corolla Hatchback XSE Sweepstakes” (the “Sweepstakes”) is sponsored by Southern California Toyota Dealers Association (“SCTDA”), 865 S. Figueroa St., Los Angeles, CA 90017-2543, in partnership with Tawa Services, Inc. d/b/a 99 Ranch Market and d/b/a Cravings by 99 Ranch Market (collectively “99 Ranch Market”), 6281 Regio Ave., Buena Park, CA 90620. SCTDA and 99 Ranch Market are collectively referred to herein as “Sponsor.” The Sweepstakes is administered by Davis Elen Advertising, an independent judging organization (“Administrator”) on behalf of the Sponsor.
Description of the Sweepstakes: The “Promotional Period” begins at 8:00 AM Pacific Time ("PT") on October 20, 2018 and ends at 9:00 PM PT on December 31, 2018. At the end of the Promotional Period, there will be a random drawing from all eligible entries to determine six (6) finalists. Each finalist must be able to attend a winner selection event to determine the one (1) Vehicle prize winner, which is scheduled to occur on January 26 2019 at 1:00 PM PT at the Cravings by 99 Ranch Market, 4024 Grand Ave, Chino, CA 91710 (the “Event”). The official clock of the Promotional Period is the Sponsor’s web server clock.
Eligibility: Except as set forth in this Section, this Sweepstakes is open only to all individuals who are: (i) eighteen (18) years of age or older as of October 20, 2018, (ii) legal U.S. residents of who currently reside within one of the following California counties: Los Angeles, San Bernardino, Kern, Orange, or Riverside, and (iii) are licensed to a drive an automobile (“Participant”).
Directors, officers, employees, contractors, agents or representatives of Sponsor, Administrator, their respective parent companies, affiliates, subsidiaries, advertising, promotion and production agencies, and their immediate family members (i.e. spouse, parent, child, sibling, and the “steps” of each) and persons living in the same household of each (collectively, “Sponsor & Others”) are ineligible to participate in the Sweepstakes and will be immediately disqualified from the Sweepstakes if found to violate any of the eligibility requirements. Sweepstakes is void where prohibited or restricted by law.
Participation constitutes Participant’s full and unconditional agreement to the Official Rules and Sponsor and Administrator’s determining factors for Prize selection, which are final and binding in all matters related to this Sweepstakes. Any attempt to tamper, block, hack or intimidate registrations by others either online or in-person registration will be grounds for immediate disqualification from the Sweepstakes. Winning the Prize is contingent upon fulfilling all requirements set forth herein.
How to enter the sweepstakes: During the Promotion Period, a Participant may receive one (1) entry into the Sweepstakes using one (1) of the following two (2) methods:
Entry Form available at select Cravings by 99 Ranch Market or 99 Ranch Market locations: Completing and submitting a Sweepstakes entry form, while supplies last, at one of the following Cravings by 99 Ranch Market or 99 Ranch Market California locations: Alhambra, Anaheim, Arcadia, Artesia, Chino Hills, Corona, Gardena, Hacienda Heights, Irvine Culver, Irvine Walnut, Monterey Park, Rancho Cucamonga, Rowland Heights, San Gabriel, and Van Nuys. For greater detail on the exact store locations, go to http://www.99ranch.com/stores. Entry forms must be legibility completed by handwriting the requested information and depositing it into the marked receptacle. Entry forms that are mechanically reproduced or obtained outside of authorized channels will not be accepted.
Alternate Method of Entry (“AMOE”): Participant may enter via AMOE by hand printing his/her complete name, street address (no PO boxes), age, telephone number, and e-mail address (if any), and “Region” as that term is defined in Section 6 of these Official Rules, and sending it as a self-addressed stamped postcard provided that the postcard is postmarked by December 31, 2018 and received by January 7, 2019 to: Tawa Supermarket, Inc., Attn: Customer Service Department/ 99 Ranch Market Toyota 2019 Corolla Hatchback XSE Sweepstakes, 6281 Regio Avenue, Buena Park, CA 90620. AMOE entries sent in an envelope will not be accepted. If no Region is entered, then the Sponsor will randomly assign the AMOE entry to a region.
Limit one (1) entry per Participant during the entire Sweepstakes Period regardless of the method of entry used.
COMPLIANCE WITH SWEEPSTAKES RULES: By participating in the Sweepstakes, each Participant hereby agrees to these Official Rules and to the Sponsor’s terms of service/privacy policy, located at: www.toyotafinancial.com/pub/w/#customer_service/online_privacy_policy. Participants are only eligible to win the prize if they are in compliance with the Official Rules. Failure to comply with the terms set forth herein will be grounds for immediate disqualification. Under no circumstances shall a Participant allow or permit any other person or third party or parties, including, without limitation, any person under the legal age to participate in the Sweepstakes on the Participant’s behalf. Any form of entry other than what is described in “How to Enter the Sweepstakes” is herein voided. All entries, regardless of the method of entry, become the Sponsor’s property and will not be returned.
VEHICLE PRIZE AND MANUFACTURER’S SUGGESTED RETAIL PRICE: One (1) winner will receive a 2019 Toyota Corolla Hatchback XSE model #6274 (“Vehicle”) which has a Manufacturer’s Suggested Retail Price (“MSRP”) of $25,405.
Vehicle is awarded “As-Is” condition subject to any warranty provided by Toyota Motor Sales, U.S.A, Inc. Any vehicle upgrades, aftermarket additions, options or other elements beyond the model details provided in these official Sweepstakes rules will be the sole responsibility of the winner, in Sponsor’s sole and absolute discretion. The winner must take delivery of the Vehicle at a participating Southern California Toyota dealership located close to the winner’s residence, as selected by Sponsor, in its sole discretion. No other delivery option will be available. Subject to availability, the vehicle will be delivered approximately 120 days from final verification of winner’s eligibility (as further described below in Section 8). The winner is responsible for taking delivery. If the winner refuses delivery, the prize may be forfeited, at Sponsor’s sole and absolute discretion. The winner is responsible for all taxes and expenses, including but not limited to: sales tax, luxury tax, destination charges, registration, title and license fees, insurance, and all other costs incurred in claiming, registering or using the vehicle. Vehicle details and availability are subject to change. In the event the Vehicle cannot be supplied for any reason, a similar vehicle of comparable value may be substituted at Sponsor's sole discretion. No substitutions, cash equivalents or transfers of the Vehicle permitted by the winner, except as permitted by Sponsor at its sole discretion. The actual style, model, make, color, design and features of the Vehicle may vary from any depictions of it in the Sweepstakes promotional materials.
With respect to the Vehicle, the winner must be a licensed driver or motor vehicle operator and will be required to produce evidence of a valid driver license and insurance certificate prior to tendering of the Vehicle to the winner.
RANDOM DRAWING FOR THE FINALISTS, SELECTION OF THE WINNER: On or about January 8, 2018, the Administrator will randomly draw six (6) potential finalists, one (1) potential finalist from each “Region”, from among all eligible entries received during the Promotional Period received by the stores located in each Region or as identified in the AMOE as set forth in Section 3(b). The Regions are:
Each potential finalist will be notified by telephone or e-mail to the phone number or e-mail address that he/she provided when registering for the Sweepstakes with complete details for the Event (the “Official Notification”). Return of an Official Notification as undeliverable or inability of Administrator to contact a potential finalist by telephone or e-mail within twenty-four (24) hours of selection, may result in disqualification of such potential finalist, and an alternate finalist may be selected by random drawing from all eligible entries received, time permitting. In the event a finalist declines to attend the Event or is disqualified, Administrator may, at its discretion, select an alternate finalist by random drawing, as described above. Alternate finalists will have twenty-four (24) hours of Official Notification to respond to Administrator. If a potential finalist fails to respond to the Official Notification he/she will have been deemed to have declined the opportunity for a chance to win the Vehicle and relinquishing all rights and involvement in the Sweepstakes and any prize.
Each finalist must attend the Event, as directed by Sponsor or Administrator in the Official Notification. Failure to attend the Event will result in disqualification and the finalist will not have a chance to win the Vehicle or any other prize. It is anticipated that the Event will be conducted in three (3) rounds, with five (5) finalists removed throughout the three (3) rounds as follows:
If there are less than 6 confirmed finalists or, for any other reason, the Sponsor reserves the right to modify this winner selection process in its sole and absolute discretion.
All gift cards are subject to the terms and conditions printed thereon. Gift cards will not be replaced if lost, stolen, or used without a finalist’s permission.
Each potential finalist and the potential winner will be subject to verification of eligibility and compliance with the Official Rules as stated herein before being named an official finalist or the winner of the Sweepstakes. Sponsor’s and/or Administrator’s decision is final and binding in all respects to this Sweepstakes. No Participant, finalist, or winner shall have the right to contest any decision by the Sponsor or Sponsor’s judging organization concerning any aspect of the Sweepstakes or the interpretation of the Official Rules or determination as to the qualification of entries into the Sweepstakes.
No more than one (1) Vehicle, three (3) Round 1 Prizes, and two (2) Round 2 Prizes are available in this Sweepstakes. The ARV of all prizes is $26,955
Odds of Winning: The odds of being selected as a finalist depend on the number of eligible entries received during the Promotional Period. The odds of any one of the finalists winning the Vehicle is 1:6.
PRIZE FULFILLMENT, AFFIDAVITS AND RELEASES: Each potential finalist must reply to the Sponsor or Administrator within twenty-four hours after the Official Notification has been sent. Failure to respond within the time permitted in these Official Rules will be viewed by the Sponsor as declining the opportunity to participate in the Event and relinquishing all rights and involvement in the Sweepstakes. If any potential finalist, potential winner, or any alternate finalist or potential winner is found to be ineligible or not in compliance with the Official Rules, declines to accept the Vehicle, or Sponsor is unable to contact a potential finalist or potential alternate finalist within the required time period, the finalist’s opportunity to participate in the Event, or, in the case of the winner, the Vehicle will be forfeited and it is the Sponsors’ sole discretion that such prize may be awarded to a new alternate potential winner. Once a potential winner has declined the Vehicle he/she may not be re-entered into the Sweepstakes or re-named as a winner (or any variation) under any circumstances as Participant’s rejection officially removes said Participant from the Sweepstakes and relinquishes all rights to anything related to the Sweepstakes. No exceptions for reinstatement will be made.
The potential winner of the Vehicle will be required to furnish proof of identification, acceptance of being declared the winner and be required to execute and return an Affidavit of Eligibility/Liability & Publicity Release and a tax acknowledgment form within five (5) business days from the date it is transmitted electronically to the potential winner as having been sent by the Administrator or the Vehicle may (at the Sponsor’s sole discretion) be forfeited and, in Sponsor’s discretion, awarded to an alternate Vehicle winner selected at random from the pool of remaining finalists who participated in round 2. If there are no qualified winners from the finalists who participated in round 2, then the potential Vehicle winner will be selected from those in round 1. The Vehicle winner will be issued an IRS Form 1099 in the amount of the actual Vehicle value and will be required to provide his/her social security number or taxpayer identification number to claim the Vehicle.
The right to receive the Vehicle or any other prize is non-assignable, non-transferable and no prize substitution, exchange or any other type of equivalent will be allowed, except by Sponsor who reserves the right to substitute a prize of equal or greater value in case of unavailability of prize or force majeure. Once the Affidavit of Eligibility/Liability & Publicity Release and a tax acknowledgment form are received by the Sponsor, Sponsor shall not be held responsible for any delays in awarding the Vehicle for any reason. The Vehicle and each prize will only be awarded to a verified winner.
LIMITATION OF LIABILITY: The Sponsor and Administrator are not responsible for illegible, lost, late, incomplete, stolen, misdirected, or undeliverable mail, email or errors in submission into the Sweepstakes.
DISPUTES: All disputes, claims or other matters regarding the Sweepstakes and/or the Official Rules will be handled in accordance with the Sponsor’s dispute resolution policy set forth in www.toyotafinancial.com/pub/w/#customer_service/online_privacy_policy.
PRIVACY POLICY AND OPT OUT: Any personally uniquely identifiable information collected during participation in this Sweepstakes will be collected by Sponsor and used by Sponsor or Administrator, on Sponsor’s behalf, (for communication and verification of potential winner or potential alternate communication), their affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Sweepstakes as described in the Official Rules and in accordance with Sponsor's Privacy Policy as stated at www.toyotafinancial.com/pub/w/#customer_service/online_privacy_policy and any opt-ins a Participant may have agreed to during the registration process. If a Participant does not wish to receive any further communication from the Southern California Toyota Dealers Advertising Association’s regarding this Promotion or future promotions or offerings, the Participant may choose to opt-out of future communication by sending Participant’s email address and his or her name and address to: Southern California Toyota Dealers Advertising Association, Attn: Communication Opt-Out, 865 S. Figueroa Street, 12th Floor, Los Angeles, CA 90017.
PUBLICITY RIGHTS: By participating in the Sweepstakes and or accepting the Vehicle, the Participant agrees to allow Sponsor and/or Sponsor's designee the perpetual right, where lawful, to use their name, biographical information, photos and/or likeness, and statements for promotion, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide, including but not limited to on the Internet, without notice, review or approval and without additional compensation except where prohibited by law. If participant is chosen as the winner, Participant’s personal identifiable information may be disclosed to third parties such as placing Participant’s name on an official Winner List.
ADDITIONAL PARTICIPATION AGREEMENTS: Participant waives all rights to claim any ambiguity in the Official Rules. In no event will additional prizes be awarded than are stated in the Official Rules. In the event that due to technical, typographical, mechanical or other errors, there will only be one (1) winner as stated in the Official Rules. Sponsor reserves the right, to disqualify any individual found, in its sole opinion, to be tampering with the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike manner or with the intent to annoy, harass, abuse or disrupt any person or the normal operation of this Sweepstakes. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Sweepstakes will void any attempted participation effected by such methods and any individual suspected of utilizing such methods will be disqualified, in Sponsor’s sole discretion. Any attempt to deliberately damage any website or undermine the legitimate operation of Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, the sponsor reserves the right to seek damages or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law. All entries and/or materials submitted become the property of Sponsor and will not be returned and no communication will be entered into. In any event of a conflict or challenge to the Sweepstakes Official Rules the details of the Official Rules shall prevail.
WINNER LIST: Any person wishing to receive a listing of the name of the verified winner must send a self-address stamped envelope no later than 45 days from the end of Sweepstakes to: Southern California Toyota Dealers Association, Attn: Winners List, 99 Ranch Market Toyota 2019 Corolla Hatchback XSE Sweepstakes, 865 S. Figueroa Street, 12th Floor Los Angeles, CA 90017.
OFFICIAL NOTICES: The Official Rules may not be reprinted or republished in whole or in part without the prior written consent of Sponsor. The information each Participant provides will only be used for this Sweepstakes.
